For Sellers
1. Are you a REALTOR ® ?
A REALTOR ® is a member of the Nation Association of REALTORS® and therefore is bound by its strict Code of Ethics. REALTORS® are committed to treat all parties to a transaction honestly and are expected to maintain a higher level of knowledge about the buying and selling process than practitioners who aren't National Association of REALTORS® members. Identify them by the REALTOR® logo on their business card, membership pin, or other marketing literature.
2. How long have you been selling real estate? Are you fulltime or parttime?
Level of experience needn't be the sole arbiter, but it helps.
3. Will you provide a written market analysis for my property? Can you explain how you determine the value?
4. What specifically will you do to get my home or land sold?
5. How often will I hear from you once I've given you the listing? Look for a salesperson who can commit to the level and method of communication-e-mail, fax, phone-you prefer.
6. Will you keep me informed about changes in the market that will affect my price and terms?
7. Do you have a licensed Realtor available during office hours to answer inquiries?
FOR BUYERS
1. Has your Realtor provided an Agency Relationships in Real Estate Transactions disclosure? Did he/she explain it clearly and do you understand it?
2. Has your Realtor informed you if his/her company represents the seller of the property you are viewing?
3. Before discussing the terms of an offer to purchase, your Realtor should provide:
Seller Disclosures for structure, land, well and septic
Representation Agreement based upon what type of agency representation you desire
A statement about the property's location in a floodplain , wetland, or shoreline, and notice of any pending changes you know of in zoning, property tax
assessments or special assessments
Current property taxes and if available, a year's worth of utility bills
A list of appliances, furniture or fixtures staying with the house.
A copy of the condo or homeowners association's covenants , bylaws, and restrictions, if applicable.
4. Ask your Realtor to provide Sold comparables for similar properties. This will help you to determine fair market value for the property you are considering.
5. Spend the money and have inspections for the house, well water and septic.
6. Be prepared to provide a letter from your lender stating you are a prequalified buyer. Most sellers will require this as a condition of your offer.
7. Expect to write a check for earnest money at the time your offer is submitted. Your check is made payable to the listing broker's Trust Account and it will be
cashed within 3 days after your offer is accepted.
8. Make sure you understand all documents before you sign them. They are legally binding so, if you intend to get legal advice, do it before you sign.
9. Expect your Realtor to monitor your transaction prior to closing to make sure all conditions have been met.
